These terms are valid from 19/12/2023.
It is our goal to help you determine if you are eligible for Italian citizenship and to assist you in assembling an accurate application to be accepted by the Italian consulate or courts of your choice.
The following are the terms of service related to the following services;

Done for You Service
If you engage our “Done for You” package you will enjoy a complete turnkey service in which we handle all of the required steps in acquiring and legalizing all of the necessary documentation to support your application. Once complete, you will receive your own Citizenship Book to present at the consulate in your jurisdiction. We require your authorization by way of limited power of attorney so that we can act on your behalf to obtain all of your records. In some cases, you may be required to sign specific orders as per government policies. You will receive a separate agreement with defining terms to services.

Naturalization Records Search
Fees include the services and do not include cost of documentation, money order fees and/or mailing and postal fees which will be invoiced separately as accumulated are due upon request.

Smart Set Up
We will evaluate your family tree and potential citizenship lines based on the documentation that you provide and advise you of all potential lines. Once you have determined the best line to follow, we will provide you access to a customized project management system for your use which we will set up based on the family line that you wish to follow. This will include the full family line, all documents required, tasks and customized plan. We are not responsible for missing or incorrect documentation provided to us by you, nor changes to the system that are made by you or the technology holder, including if you accidentally delete the account or cause any other technical changes to the data that we have entered. If you wish us to re-do the set up, we will charge a second set up fee.

Unlimited Email Support
You can submit unlimited email support requests to assist you in determining the required documents, problems with discrepancies, legal procedure, application procedure and general questions. We endeavour to reply within one business day although in the case of high demand, we may take longer. Any citizenship related question is welcomed, with the following exceptions:
- Requests to review document(s)
- Requests to review family linage.
- Requests to translate document(s)
- Questions relating to another application other than yours


Changes to Italian Citizenship Laws
Smart Move Italy, and any of its affiliates are not responsible for changes in Italian law that occur either before, during or after your appointment that may directly or indirectly impact your success. Client acknowledges and agrees that there are many issues outside of our control in relation to obtaining Italian Dual Citizenship, and therefore we do not guarantee in any way that the services will result in the grant of Italian Dual Citizenship.

Liability
We will use reasonable endeavour to perform and deliver activities listed in the service you purchased, including procuring performance by a third party when and if necessary. We will keep the principal informed of any circumstances which may result in any obstacle in performing this engagement.
We cannot know what we will find until we being to research your genealogy therefore will not be liable in case a document cannot be found, also in the event that a specific genealogy search was performed, and the result was negative. We will, however, advise you on the best next steps you can take (if any) to recover your linage.

Refunds
These terms shall commence on the date of the payment for the service. Our engagement can be terminated at any time by you by written communication via email or registered letter or by us by written communication, via email or registered letter. Any expenses already incurred or that are already in the process and cannot be stopped, shall be paid by you upon early termination of this agreement. Deposits and payments made prior to termination will be deemed to have been earned at the commencement of the service and are non-refundable.

Split Payment Option
Options to split payment are considered earned at the time of order and on the initial payment. Once work has been commenced, the full fee (plus interest) is deemed to be earned. Failure or refusal to pay one or more of the agreed payments can result in termination of the engagement and grants us the right to utilize collections services to recover the lost payments.


Collection of Italian Documents
The Support Plus package includes the collection of Italian documents. We will attempt to collect the vital records required for the application line that you have selected. We cannot guarantee that the document will be available but will make every effort to locate the documents. In the event that a document cannot be found, we will advise you on potential alternatives which are not included in this service. Document fees including stamp tax and postage are not included.

No Guarantee of Citizenship
We will do our best and utilize all efforts to assist you in successfully claiming your Italian citizenship, however we cannot guarantee the success and therefore you agree to hold Smart Move Italy and its affiliates harmless for any negative response from either the Comune or Italian Consulate. You also agree that we are not an employee of the Italian government and cannot influence nor predict any outcome.
